Guardianship, Power of Attorney and the employment of family members as PAs

This workshop will explore the issues around the employment of family members as PAs, particularly in relation to Guardians and POAs.

As people struggle to find the support they need in their local area, or have very specific support needs, some people might consider employing a family member as their Personal Assistant. There are special rules that relate to the employment of a family member as a Personal Assistant and this is considered to be an ‘exceptional circumstance’.
For those people who lack capacity and have a Guardian or Power of Attorney, who are often a family member, the rules around being employed as a Personal Assistant for the person you are the Guardian or Power of Attorney for, are more complex.
This workshop will explore what the legislation and guidance say in relation to the employment of Guardians and Powers of Attorney, what the options and issues are and what people might need to consider when approaching their Local Authority with such a request.
